Regional Planning Commission

In an effort to comply with Tennessee Open Meeting requirements and to provide all parties an equal opportunity to be heard by the entire Planning Commission during the public hearing on your case, the Planning Commission members are unable to speak to you or read and respond to written communications on agenda items before action is taken in a public hearing during the Planning Commission meeting each month.

As your feedback is important to the process, you are encouraged to attend and provide your input at the monthly Planning Commission meetings.

If you are unable to attend the meeting(s) or if you would like to also provide written comments to the Planning Commissioners, you may provide your input by emailing rezoning@chattanooga.gov or by contacting the staff of the Planning Commission at the Chattanooga-Hamilton County Regional Planning Agency at (423) 643-5902. Any communications before the monthly meetings will be provided to all Planning Commissioners during the public hearings of the Chattanooga-Hamilton County Regional Planning Commission each month.

Public Input on Subdivisions

The public is invited to participate in the meeting and will be given an opportunity to express support or opposition to requests or to ask questions. However, a few things to keep in mind: The Planning Commission may only deny a subdivision plat if sufficient evidence is given to demonstrate any of the following: 1) the plat fails to conform to the standards of the Subdivision Regulations; 2) approval of the plat would be detrimental to the public safety, health, or general welfare; 3) approval of the plat would not be in the best interest of the local government.

Because the Planning Commission’s decisions for subdivision requests are “quasi-judicial” in nature, by law, the Planning Commission can only consider a general opinion or concern expressed at a hearing which is adequately supported by factual information.  Factual information may include property deed information, traffic incident data, photographs of the area, technical memorandums from certified professionals or other evidence based materials that is established by qualified experts in the field.  Mere opinions or statements which are not supported by facts cannot be the basis for denial of a subdivision plat by the Planning Commission.

The public is invited to participate in the meeting and will be given an opportunity to express support or opposition to requests or to ask questions.

Infrastructure & Operational Issues

The Planning Commission has no authority over traffic regulations, building and development codes, and stormwater/water quality or flood regulations.
